Update on Opioid Settlements

Municipalities should be aware of the requirements for receiving funds from settlements of national litigation with Purdue and the Sackler family as well as with eight other opioid makers. The due dates for opting into the settlement agreements are September 30 for the Purdue/Sackler settlements and October 1 for the “eight additional defendants” settlement. Municipalities should ensure that voting on the settlement agreements is included on meeting agendas with sufficient time to meet these deadlines.
Municipalities should now have received instructions from Settlement Administrator Rubris for submitting the Governmental Entity Settlement Agreement relating to the Sackler settlement and will soon receive, if not already received, instructions from Rubris for completing the Participation Form relating to the eight defendants’ settlement. The Attorney General has estimated how much each municipality is expected to receive from the Purdue/Sackler settlement and from the eight defendants’ settlement.
Some municipalities may also receive instructions from the Purdue bankruptcy administrator regarding voting on the Purdue Chapter 11 Plan of Reorganization. Voting on the Plan is not necessary to receive the benefits of the settlement. Note that obtaining the maximum amount of settlement proceeds is contingent upon the Plan’s approval.
